房屋委托公证又称房屋委托书公证,是公证机构最常办理的公证业务之一,但办理该项业务时公证员多有困惑之处,此种困惑源于对房屋委托书公证的审查。办理房屋委托书公证,公证员的尚方宝剑是中国公证协会于2008年4月23日颁布的《办理房屋委托书公证的指导意见》(下简称《指导意见》),然而法律具有与生俱来的滞后性,《指导意见》逐渐表现出设计初衷的理想化和对发展的不适应,特别是2011年10月1日正式启用新版定式公证书后,《指导意见》如何与新版定式公证书格式更好地融合适用,是摆在公证员面前的一个亟待解决的问题。
