根据我国《合同法》第52条第5项,违反法律、行政法规的强制性规定的合同无效。该条款的内容过于抽象,需要发展出具体的裁判规则。整体而言,司法实务逐渐从形式标准转变为实质标准,从较宽的认定转变为较严的认定。我国法院也发展出了多种审查策略。然而,无论是规范重心的认定、规范目的的探求,还是履行阶段的区别处理、向公共利益的转化判断,均只能适用于有限的案型,无法作为一以贯之的判定标准。公法规范对于合同效力的影响,只能就个案的具体情形,权衡相冲突的法益而为判断。法益权衡和司法裁判过程中的价值补充,尚应遵循比例原则的基准。
According to Article 52 Clause 5 of the “Contract Law”, contracts that violate the mandatory provisions of laws and administrative regulations are invalid. The content of this article is too abstract and requires the development of specific rules of adjudication. As a whole, the judicial practice has gradually shifted from formal standards to substantive standards, shifting from a broader recognition to a more rigorous determination. Our courts have also developed a variety of censorship strategies. However, whether it is the determination of normative center of gravity, the quest for normative purposes, the differential treatment in the fulfillment phase and the transformation to the public interest can only be applied to limited cases and can not be used as a consistent criterion. The influence of the public law norms on the effectiveness of the contract can only be judged on the specific circumstances of the case and on the trade-off between the conflicting interests. Legal rights and interests of the process of judicial adjudication value added, should still follow the principle of proportionality.
