长期以来,亚里士多德是大家公认的法治思想起源,然而笔者经过对柏拉图和亚里士多德两位法学先驱著作的比较研究,发现亚里士多德和柏拉图的思想其实是一脉相承的,认为法治思想应当起源自柏拉图,而非大家普遍公认的亚里士多德,并且柏拉图前期的所谓“人治”思想和后期的思想,实际上也没有本质的不同,不过是具体形式的差异。
Aristotle has long been recognized as the origin of the thought of the rule of law. However, after comparing the two pioneering works of law by Plato and Aristotle, the author finds out that Aristotle and Plato’s thoughts are in fact the same strain Argues that the idea of the rule of law should originate from Plato instead of Aristotle, which is universally acknowledged by everyone, and there is in fact no essential difference between the so-called “rule of man” and the latter thoughts in the early Platonic episode, but it is a concrete form difference.
