本文认为,外观设计定义中的“富有美感”更确切的含义是“为了美感”。“为了美感”或者主要是“为了美感”设计的产品外观,属于外观设计专利的保护客体;“为了功能”或者主要是“为了功能”设计的产品外观,则不属于是外观设计专利的保护客体。本文建议,在《专利审查指南》中应当增加以下规定,由功能或者主要由功能决定的产品外观以及实际使用中处于隐藏状态的产品外观不属于外观设计专利保护的客体。 This paper argues that the more precise meaning of “rich sense of beauty ” in the definition of design is “for beauty ”. “For beauty ” or mainly “For beauty ” design of the product appearance, belongs to the design patent protection object; “For function ” or mainly “For function ” design of the product appearance, Belonging to the protection of design patent object.
