私募基金是因资本主义发展所导致,在资本主义社会发展中产生。私募基金不同于公募基金,也和单纯字面意义上的地下基金相异,它是非法的不受监管的基金,它的募集、运作等一系列资本活动受到多方面监督,也可以理解为非法融资手段的一种。私募基金起源于美国,并于上世纪九十年代进入我国市场,可以说,私募基金在我国完全处于一个成长期,在我国存在很大的上升空间,巨大的资金对于我国资本市场是一个强有力的助推器。但是在经历了二十多年发展,发现这样一个资本工具存在着一定的缺陷,无论是在立法监管方面还是其本身的运行,都有着需要更加规范的地方。伴随本国经济实力的逐渐增强,私募基金市场也必将迎来一个很好的成长契机。作者通过国内外学者的研究成果的研究与借鉴,加上对于我国私募基金市场的简要分析,其认为,私募基金在我国要想得到长足并有效的发展,现阶段以及将来必须做到以下几点:1、使私募基金合法化的进程更加完善;2、加强私募基金的运行过程并进行立法监督;3、对于行政的指导干预也必须加以规范化。 Private equity funds are caused by the development of capitalism and arise in the development of capitalist society.
