在我国,公用企业垄断的现象极为严重,公用企业垄断是我国反垄断执法关注的重点。《反垄断法》出台后出于种种原因,并未对反垄断执法机构与行业监管机构的关系及权力配置予以厘清,导致了实践中反垄断执法机构与各行业监管机构间的权力冲突愈趋频繁、激烈。因此,我们必须对上述两类机构之间的反垄断权限进行划分。反垄断执法机构与行业监管机构间的权限划分一般有三种模式,而反垄断执法机构与行业监管机构分权的模式是目前最适合中国国情的模式。
