职务犯罪轻刑化问题表现为适用比例总体较高、部分涉案金额大、罪名分布广、从轻情节宽泛、执法不均衡等五个方面。造成该现象的原因有法律层面不够完善、检察环节和审判环节执法不规范、执法环境有干扰等。本文认为应在认真分析这些复杂原因的基础上通过完善立法、提升办案质量、强化监督职能等措施有效加以解决。
The light punishment of job-related crimes is manifested in the following five aspects: the relatively high proportion of the applicable crimes, the large amount involved in the crimes, the wide distribution of charges, the leniency of the plot, and the unbalanced law enforcement. The reasons for this phenomenon are the imperfect legal aspects, the non-standard law enforcement in procuratorial and trial stages and the interference with law enforcement environment. This paper argues that measures such as improving legislation, improving the quality of case handling and strengthening the supervision function should be effectively solved on the basis of carefully analyzing these complicated causes.
