食品安全是关乎老百姓生命、健康的头等大事,也是全社会都紧密关注的民生问题之一。在瘦肉精、地沟油、苏丹红陆续出现的当今社会,如何厘清生产、销售不符合安全标准的食品罪与生产、销售有毒、有害食品罪的区别,准确适用刑法,维护国家管理制度,保障公众利益,是我们每一位法律监督者都必须正视的问题。本文将以工作实际作为出发点,以法律、法规、司法解释等的新旧更替作为分析逻辑,试图对上述问题作出分析说明。
