香港澳门回归后,为妥善处理内地与港澳之间的区际关系,内地分别与两地达成了一系列“安排”并且在实践中发挥了很大作用。但“安排”并非正式的法律渊源,其效力不好保障,与其他法律渊源冲突时也不能通过《立法法》协调。而“安排”在处理我国一国两制下特有的区际关系中的重要作用又使其在相当长的时期内很有生命力,从其产生过程来推理抑或从法律渊源的标准来衡量,它都具有法律渊源的特征,所以“安排”可以并且应当成为一种正式的法律渊源,以符合实际需要并使其更好地发挥作用。
After the handover of Hong Kong and Maucao, in order to properly handle the inter-regional relations between the Mainland and Hong Kong and Maucao, the Mainland respectively reached a series of “arrangements” with the two countries and played a significant role in practice. However, “arrangement ” is not an official source of law. Its effectiveness is not guaranteed and it can not be coordinated through the “Legislation Law” in conflict with other legal sources. And the important role of “arrangement ” in handling the peculiar inter-regional relations under the principle of one country under two systems has rendered it vitality for quite a long period of time, measured by its production process or from the sources of law Has a legal origin, so “arranging” can and should become a formal source of law that meets the needs of the real world and allows it to function better.
