非法储存爆炸物罪旨在控制爆炸物的流通,打击此类犯罪目的的实现需要通过立法与解释论的齐头并进。从立法上看,2001年颁布的司法解释将“储存”的范围过分限缩,造成理论与实务脱节,对此2009年颁布的司法解释进行了修正。从解释论上看,对“储存”不应拘泥于行为性质系作为抑或不作为的讨论,而是要从机能性出发,根据证明内容和打击需要认定行为性质。在“储存”的主观评价上,需要采取推定或规范的评价视角,解决此类案件中举证困难的问题。
The purpose of illegally storing explosives is to control the circulation of explosives. The realization of the purpose of combating such crimes needs to go hand in hand with legislation and interpretation. From a legislative point of view, the judicial interpretation promulgated in 2001 narrowed the scope of “storage ” and caused the separation of theory and practice. The judicial interpretation promulgated in 2009 was amended. From the perspective of interpretation, “storage” should not rigidly adhere to the discussion of whether the nature of behavior is as an act of omission or not. Rather, it should proceed from a functional perspective and identify the nature of the act according to the content of the proof and the need to combat it. In the subjective evaluation of “storage ”, we need to take a presumptive or normative evaluation perspective to solve the problem of the burden of proof in such cases.
