已实施多年的《消费者权益保护法》将迎来第一次大的修改,并列入了全国人大常委会5年立法规划。2009年6月9日,中国人民大学商法研究所所长刘俊海教授介绍了消法修改的重点,包括建议建立产品召回制度和对“网上交易”产品建立消费者冷静期制度。[1]同时,在我国加入WTO的报告中第310条郑重承诺:三年内对没有固定场所的销售开放直销市场。因此,笔者将对直销冷静期制度立法问题提出相关建议和对策。
The “Consumer Protection Law”, which has been implemented for many years, will usher in the first major revision and be included in the five-year legislative plan of the NPC Standing Committee. On June 9, 2009, Professor Liu Junhai, director of the Institute of Commercial Law of Renmin University of China, introduced the key points of the consumer law revision, including the proposal of establishing a product recall system and establishing a consumer cool-off system for the “online transaction” products. At the same time, Article 310 of our report on China’s accession to the WTO solemnly promises: to open the direct sales market to those who do not have any fixed place within three years. Therefore, I will put forward the relevant proposals and countermeasures on the legislation of the direct selling cool-off period.
