众所周知,中国城市化进程不断加快,城市可利用的土地资源严重不足,成为了制约房地产市场发展的关键因素。在房价飙升的今天,能够拥有自己的住房是很多人的梦想。受制于经济条件又想拥有自己住房,价格低廉的小产权房便应运而生。小产权房的出现,从一定程度上缓解了现存的购房压力,但也引发了一系列深层次的法律制度问题。究竟该如何妥善处理这一矛盾,已成为当前我国政府和法律无法忽视的一个问题和挑战。近年来,国家开始针对小产权房开展整治工作。在此背景下本文围绕小产权房的治理难题,从背景、概论、权利归属和解决办法等方面进行了系统研究。
As we all know, the accelerating process of urbanization in China, a serious shortage of available urban land resources has become the key factor restricting the development of the real estate market. Today, the soaring house prices, to have their own housing is the dream of many people. Subject to the economic conditions and want to own their own housing, low-cost small property room came into being. The emergence of small property housing, to some extent, to ease the existing pressure on the purchase, but also triggered a series of deep legal issues. How to properly handle this contradiction has become a problem and challenge that can not be ignored by our government and the law at present. In recent years, the state began to carry out renovation work for small property houses. In this context, this article focuses on the governance of small property room, from the background, overview, rights and solutions and other aspects of a systematic study.
