计算机辅助量刑是自第四次工业革命的浪潮在刑事司法领域的具体体现,表现为通过计算机程序内置逻辑规则,根据用户输入的犯罪事实数据,自动计算并生成宣告刑的过程。计算机辅助量刑过程具有快速性、同一性、可视性的特点,有利于避免法官量刑的随意性,避免“重定罪、轻量刑”的不良量刑倾向。其定量分析的特点有利于实现同案同判,展示量刑内部运行机理,是对我国刑事司法实践改革的有益尝试。本文将以笔者自行开发的《基于专家系统的计算机辅助量刑系统》的运行原理为例,尝试论述计算机辅助量刑的可行性问题及其实具体原理。
Computer-aided sentencing is the embodiment of the wave of the Fourth Industrial Revolution in the field of criminal justice. It is manifested in that the logic of computer programs is used to automatically calculate and generate the sentence according to the criminal fact data entered by the user. The process of computer-aided sentencing has the characteristics of fastness, identity and visibility, which helps to avoid randomness of judges’ sentencing and avoids the unfavorable sentencing tendency of “re-conviction and light-weight punishment ”. The quantitative analysis of the features is conducive to achieving the same case with the same sentence to demonstrate the internal mechanism of sentencing is a useful attempt to reform China’s criminal justice practice. This paper will take the author’s self-developed “expert system-based computer-aided sentencing system” as an example of the operating principle, trying to discuss the feasibility of computer-aided sentencing and in fact the specific principles.
