近些年来,随着物业管理纠纷的日益增多,社会各界对业主权益的维护问题给予了高度关注,而对物业管理企业自身的发展及权利保护问题的关注则明显不够。笔者从防范物业管理企业的风险、维护其合法权益出发,分析了风险形成的原因,探讨了在“建管脱节”的情况下如何有效地防范物业管理风险,提出了建立物业保证金制度的设想。
In recent years, with the increasing number of property management disputes, all sectors of society have paid great attention to the protection of the rights and interests of owners, while the concern about the development and protection of property rights of property management enterprises is obviously insufficient. From the perspective of preventing the risk of property management enterprises and safeguarding their legal rights and interests, the author analyzes the reasons for the formation of risks and discusses how to effectively prevent the risk of property management under the condition of “building away from control” and puts forward the idea of establishing property guarantee system.
