以淘宝和国家工商总局交锋为例研究中国电子商务监管体制,介绍中国电子商务监管的现状:电子商务发展现状、政府监管的现状及问题的严重性。然后从立法刚处于起步阶段、多头监管、过度依赖政府,没发挥社会和市场力量、电子商务的特殊性所需技术、人员、设备不足等角度分析中国电子商务监管存在问题,再以阿里巴巴和国家工商总局的博弈过程印证上述原因,并在以上基础上提出对策建议:完善建立相关监管法律法规、明确监管职责权限、完善监管方式以及政企良好互动。本文基于行政管理的角度进行分析以期实现中国电子商务从野蛮生长到规范发展。
Taking the confrontation between Taobao and State Administration for Industry and Commerce as an example, this paper studies the regulatory system of e-commerce in China, and introduces the status quo of e-commerce regulation in China: the status quo of e-commerce development, the status quo of government regulation and the seriousness of the problems. Then we analyze the existing problems in the regulation of e-commerce in China from the perspectives of the legislation being in its infancy, long-term supervision, over-reliance on the government, lack of social and market power, the technology, personnel and equipment required for the particularity of e-commerce. Then, The game process of SAIC confirms the above reasons and puts forward countermeasures and suggestions based on the above: perfect the establishment of relevant supervisory laws and regulations, clarify the powers and responsibilities of supervisory responsibilities, improve the supervision mode and the good interaction between government and enterprises. This article is based on the analysis of administrative management in order to achieve the development of China’s e-commerce from barbarism to standardization.
