《跟单信用证统一惯例(1993年修订本)》,即国际商会第500号出版物(简称UCP500),在第49条“款项让渡”中规定:“信用证未注明可转让,并不影响受益人根据适用法律规定将信用证项下应得款项让渡给他人的权利。本条款所涉及的仅是款项的让渡,而不是信用证项下执行权利的让渡。”。 由上可见,UCP500第49条所指“款项让渡”(assignment of proceeds)仅指受益人可根据适用法律规定将信用证项下应得款项让渡给他人的权利,至于信用证项下执行权利的让渡则必须开立可转让倌用证。另外,该条所指“款项让渡”也不包括通过汇票的背书
The Uniform Practice for Documentary Credits (1993 Revision), the International Chamber of Commerce’s No. 500 publication (abbreviated as UCP 500), stipulates in Article 49 “Payment of Debt”: “The letter of credit is not marked transferable, and It does not affect the right of the beneficiary to transfer the amount due under the credit in accordance with the applicable law. This provision refers only to the grant of the sum of money, not to the expropriation of the right under the credit.". It can be seen from the above that the “assignment of proceeds” referred to in Article 49 of the UCP 500 refers only to the right of the beneficiary to transfer the amount due under the letter of credit to others under the applicable law, as far as the letter of credit is concerned. The transfer of rights must open a transferable license. In addition, the “amount of money” referred to in this article does not include the endorsement of the draft.
