《贸易便利化协定》是“巴厘一揽子协定”的一部分,将依据《WTO协议》第10.3条的规定经过2/3多数成员接受后,作为修正案并入《WTO协议》附件1A(GATT 1994),并于2015年7月31日之前正式实施。《协定》是完成多哈发展议程的重要基石,预计能极大地促进国际贸易增长。《协定》除致力于贸易便利化措施的各种具体安排之外,为突出多哈回合的“发展”特色,在有关发展中成员特殊与差别待遇、能力建设及技术援助、例外及豁免、争端解决等项制度安排上有诸多独特之处,作出了许多前所未有的突破。但是,这些安排能否真正促进发展中国家的对外贸易增长,缓解发展中国家实施《协定》所面临的巨大执行负担,仍有待实践检验。
The Trade Facilitation Agreement is part of the “Bali Package Agreement.” It will be accepted as a two-thirds majority according to Article 10.3 of the WTO Agreement and incorporated as an amendment into Annex 1A of the WTO Agreement (GATT 1994), and will come into effect by July 31, 2015. The Agreement constitutes an important cornerstone of the Doha development agenda and is expected to greatly contribute to the growth of international trade. In addition to the various arrangements dedicated to trade facilitation measures, the Agreement, in order to highlight the “development” character of the Doha Round, is also relevant to the special and differential treatment of developing country members, capacity-building and technical assistance, exceptions and exemptions, Dispute settlement and other items of institutional arrangements have many unique features, made many unprecedented breakthroughs. However, whether these arrangements can really promote the growth of foreign trade in developing countries and ease the enormous implementation burden imposed on them by developing countries remains to be tested by practice.
