通过对比刑事诉讼法对侦查机关及检察机关证明要求之间的异同 ,指出检察机关拥有侦查指导权既有刑事诉讼法律依据 ,也有相应的法理基础 ;同时指出检察机关拥有侦查指导权的必要性和意义 ,提出在不改变现有司法体制的前提下 ,可采取检警双方定期交流、适时介入侦查活动、建立类似派驻看守所式的检察室等方式来实现侦查指导 By contrasting the similarities and differences between the Criminal Procedure Law and the requirements of the prosecutorial organs, this paper points out that the procuratorial organs have both the legal basis and the legal basis for the criminal procedure of investigation and guidance.
