根据中央联合声明和香港特别行政区基本法的规定,在未来的特别行政区,香港现行公务员制度基本保留。“基本保留”不等于全部保留、一成不变。随着中国对香港恢复行使主权,香港公务员制度必然发生实质内容的变化。其中最突出的就是要体现“一国两制”的原则。一、公务员范围的变化香港现行公务员的范围十分广泛,根据《殖民地规则》有关公务员的规定,它不仅包括一般公职人员,而且也包括港督;它不仅包括政府官员,也包括法官;它不仅包括事务类公务员,也包括政务类公务员,行政局和立法局两局的议员、检察官、警官,以及在政府服务的各种专业人士。也就是说,几乎所有由香港政府财政支付薪金的人员都包括在公务员的范围之内。
According to the provisions of the Central Joint Declaration and the Basic Law of the Hong Kong Special Administrative Region, the present civil service system in Hong Kong is basically retained in the future special administrative region. “Basic reservation” does not mean that all reservations remain unchanged. As China resumes the exercise of its sovereignty over Hong Kong, the substantive changes in Hong Kong’s civil service inevitably occur. The most prominent of these is the principle of “one country, two systems”. I. CHANGES IN THE SCOPE OF THE CIVIL SERVICE Hong Kong’s existing civil servants have a wide range of civil servants. According to the Civil Service Rules of the Colonial Rules, they include not only general public officers but also governorships. They include not only government officials but also judges. They include not only civil servants, Administrative civil servants also include government civil servants, members of the Executive Councils and Legislative Councils, prosecutors, police officers and various professionals serving the government. That is to say, almost all the personnel paid by the Hong Kong government for their financial support are included in the civil service.
