平等权是公民的基本权利之一,本质是反对歧视、禁止不合理的差别对待,但是我国农民至今在政治、经济、文化生活中长期居于从属地位。在构建和谐社会的今天,以法律途径保障农民平等权已成为现实课题。本文以农民平等权为研究对象,在城市化和法治化进程加快、“三农”问题得到高度重视的社会背景下,通过对农民群体生活现状进行分析,试重构法律体系中农民的地位,并借此探索保护农民平等权可能和有效的途径。 Equality is one of the basic rights of citizens. In essence, it opposes discrimination and prohibits unreasonable discrimination. However, our peasants have so far enjoyed a subordinate position in political, economic and cultural life. Today, in the process of building a harmonious society, it has become a practical issue to protect the equal rights of peasants by legal means. In this paper, the equal rights of farmers as the research object, in the process of urbanization and legalization to speed up, “three rural ” issue is highly valued in the social context, by analyzing the status quo of peasant groups, try to reconstruct the peasants in the legal system And to explore possible and effective ways to protect equal rights of peasants.
