新西兰调解制度实行国家立法与民间准则各司其职、双管齐下的模式,关于调解的定义也是多元而不统一的。民间调解和法院附设调解是新西兰两种最主要的调解模式,二者各自遵循相关的专门立法并适用不同的调解程序。保密制度是新西兰调解制度的最重要内容。与此同时,新西兰对调解员的选任、职责以及民事司法豁免权等方面也都作了详细的规定。学界就调解制度是否应当统一立法经过了激烈讨论,目前的主流观点是统一立法弊大于利。
The New Zealand Mediation System carries out the two-pronged approach of implementing both national legislation and non-governmental guidelines. The definition of conciliation is also pluralistic and non-uniform. Civilian mediation and court annexation mediation are two of New Zealand’s leading mediation modalities, both of which follow relevant specialized legislation and apply different mediation procedures. Confidentiality is the most important part of New Zealand’s mediation system. In the meantime, New Zealand has also made detailed provisions on the appointment of mediators, their duties and their immunity from civil jurisdiction. The academic circles have heatedly discussed whether the mediation system should unify the legislation and the current mainstream view is that unified legislation outweighs the benefits.
