劳动关系是劳动权利的基础。如果用工单位未经登记注册,就属于非法单位:劳动者为其提供劳动双方之间的关系不属于劳动关系,劳动者就无法保障自己的劳动权利。在建筑、矿山等劳动密集型行业发包方或承包方将工程发包或转包给未经登记注册的单位或自然人(简称非法单位)的现象比较突出为这些非法单位提供劳动的劳动者的权利受损严重。而立法则是根治这一顽疾的良策。
