作者认为,集体企业财产权状况的明显弊端是集体组织成员对企业财产的"无差别占有"性。即集体组织成员个人不存在出资份额,在参与企业决策管理、分配企业利润和承担亏损责任等方面均无差别,这种典型的"大锅饭"和平均主义严重制约着集体企业职工积极性和创造性的发挥,影响企业经济效益的提高。为此,作者提出了集体企业产权制度改革的方向和途径,即通过清产核资、界定产权、区别情况,分别改组为公司、合伙企业、合作企业和独资企业。
The author believes that the obvious disadvantage of the collective property rights of collective enterprises is that the members of the collective organization have “undifferentiated possession” of the company’s property. In other words, there is no difference in the share of the collective organization members’ personal investment. There is no difference in the participation of the enterprise’s decision-making management, the distribution of corporate profits, and the assumption of liability for losses. This typical “big pot” and equalitarianism seriously restrict the enthusiasm and creativity of the collective enterprise employees. , affecting the economic efficiency of enterprises. For this reason, the author puts forward the direction and approach for the reform of the collective property right system of the collective enterprises, namely relocating them to companies, partnerships, cooperative enterprises, and wholly-owned enterprises by clearing nuclear assets, defining property rights, and differentiating circumstances.
