对1996年～2004年间国内中药复方专利的申请数量和质量变化进行了全面统计,并分析了中药复方专利授权量和失效量的情况,以及中药复方专利的现状及存在问题。统计显示,中药复方专利申请的数量基本处于每年递增的态势,尤其职务申请情况近年明显增加,但中药复方专利的质量不容乐观,专利授权率、失效率均很高。分析其原因,可能与审查标准设置过低,造成申请数量大、技术含量低、转化实施少有关。
The author made a comprehensive statistics on the quantity and quality change of the applications for the Chinese traditional medicine compound patent from 1996 to 2004, and analyzed the authorized amount and invalidation amount of the Chinese patent compound patent as well as the current situation and existing problems of the Chinese patent compound patent. Statistics show that the number of TCM compound patent applications is basically on an increasing trend each year. In particular, the number of job applications has increased significantly in recent years. However, the quality of Chinese patent compound patents is not optimistic, and the patent authorization rate and failure rate are both high. Analysis of its causes, may be set too low with the review criteria, resulting in a large number of applications, low technical content, implementation of the conversion less relevant.
