诉讼救济的有限性与非讼救济的非中立、程序规范的缺乏及纠纷解决效力的不确定性等共同构成了当前我国教师权利救济的困境,故对我国教师权利救济必须要进行相应的改革与完善。从宏观层面上看,完善我国教师权利救济机制时应予遵循或考虑:确保救济机构的中立性、程序性规范的完善、处理决定效力的确定性及借鉴当前知识产权“三审合一”模式完善教师权利的诉讼救济等。
The limitation of litigation remedy and the non-neutrality of non-litigation relief, the lack of procedural norms and the uncertainty of effectiveness of dispute resolution constitute the current predicament of the relief of teachers ’rights in our country.
