现实生活中,他人采用伪造、盗用权利证书、身份证明或其他交易文件的手段,并以财产权利人的名义处分已登记不动产的事件时有发生。对此类案件如何认定,无论在法学理论上还是司法实务中,均缺乏清晰合理的判定基准,以致学术探讨或司法裁判多有分歧。本论文以一起真实案例为样本,根据善意取得、无权处分、无权代理、表见代理相关制度,分析关注此案的众多专家学者的各种观点,提出个人见解:即本案不适用善意取得,也不适用表见代理,应在不影响交易安全的前提下,保护所有权人的所有权。
