经济补偿金随着《中华人民共和国劳动法》的颁布,作为一项保障劳动者权益的制度被正式在我国提出和确立,在平衡劳动合同主体利益之间发挥着重要作用,本文通过分析和定位经济补偿金的性质,探讨经济补偿金的适用范围、支付标准,并进一步通过经济补偿金制度在实施过程中存在的问题和不足,发掘立法缺陷,结合我国国情提出针对劳动合同法中的经济补偿金的立法完善建议。
