0.引言在我国现行立法框架下,作为不动产的房地产实际上是国有土地使用权和地上建筑物所有权所结合而成的不动产物权。我国宪法第十条规定,土地所有权禁止转让。土地管理法第二条规定:“中华人民共和国实行土地的社会主义公有制,即全民所有制和劳动群众集体所有制。”“任何单位和个人不得侵占、买卖或者以其他方式非法转让土地。
0. Introduction In the current legislative framework of our country, real estate as real estate is actually a real estate right that is a combination of state-owned land use rights and above-ground building ownership. Article 10 of China’s Constitution stipulates that land ownership is forbidden to be transferred. Article 2 of the Land Administration Law stipulates: ”The People’s Republic of China implements the socialist public ownership of land, that is, ownership by the whole people and the collective ownership of the working people." No unit or individual may occupy, trade or illegally transfer land.
