社会结构理论对于民间法研究具有意义。“社会的三元结构理论”试图突破国家与社会二分的传统理论框架,其目的是为民间法的生成和社会自治创设空间。但从本质上看,社会的三元结构理论并没有走出国家与社会的二分结构,因而其对民间法的意义就具有局限性。当代社会是一个多元结构,社会结构多元决定着“国家控制型”和“自治型”民间法与我们渐行渐远。既具有内在的独立品格、又具有开放性和包容性的“回应型”民间法是社会结构多元发展的必然结果。
The theory of social structure is of great significance for the study of folk law. The theory of ternary structure of society attempts to break through the traditional theoretical framework of the dichotomy between state and society. Its purpose is to create space for the formation of civil law and social autonomy. However, in essence, the theory of ternary structure in society has not gotten out of the dichotomy of state and society, so its significance to the law of folk has its limitations. The contemporary society is a multi-dimensional structure. The pluralistic social structure determines that the “state-controlled” and “autonomous” civil laws are going away from us. Not only is it inherently independent, but also open and inclusive? The “responsive” civil law is the inevitable result of the diversified development of social structure.
