本文探讨一个保险实践中存在的普遍性的认知上的误区,即房地产保险价值的确定问题。房产保险的保险价值中不应该包括与标的物有关额土地使用权的价值。土地使用权价值是一种完整的价值转移,它不依附于房产价值本身,而是一种独立存在的价值。将土地使用权价值作为房产保险标的的做法于理无据,实践上也是严重侵害投保人利益的行为。
This article explores the universal cognitive misunderstanding in the practice of insurance, that is, the determination of the value of real estate insurance. The insured value of property insurance should not include the value of the land use rights in relation to the subject matter. The value of land use rights is a complete transfer of value, it does not depend on the value of the property itself, but an independent value. The practice of using the value of land use rights as the subject of real estate insurance is irrational and in practice is a serious violation of the interests of policyholders.
