本文从国际社会造法机制变迁的角度分析和解读了日本上智大学村濑信也教授的《国际立法——国际法的法源论》一书。该书不少学术亮点值得国内学界重视。村濑教授提倡的动态造法论,对国际造法中的主体、参与者、过程、机制、外部条件、结果等加以考察,大大拓展了学界对国际造法问题研究的广度和深刻。村濑教授对习惯法的历史分析亦颇具洞见,指出习惯法承担起一般国际法的职能,是国际法走向实在化的结果,背后隐藏着国际法正当性话语的历史变迁过程。此外,村濑教授对国际法委员会工作及其现实困境的剖析也堪称到位,凸显了当下专家型立法在国际社会中日益边缘化的处境。
This article analyzes and interprets the book “International Legislation - Source of Law of International Law” from the perspective of changes of the making method of the international community in Japan. Many academic highlights of the book deserve the attention of domestic academia. The theory of dynamic creation advocated by Professor Murase examines the subject, participants, processes, mechanisms, external conditions and results in international man-made practices and greatly expands the breadth and depth of scholarship in the study of international man-made law. Professor Murae also made some insight into the historical analysis of customary law. He pointed out that the customary law should assume the function of general international law as a result of the actualization of international law and hide the historical changes of the discourse of legitimacy of international law. In addition, Professor Murae laid a good foundation for analyzing the work of the International Law Commission and its current difficulties, highlighting the current situation of increasingly marginalized expert legislation in the international community.
