引言一九八四年十一月一日前,香港有关物业转易及财产的法律大部份是以英国普通法为依据,但亦受制于为处理涉及财产的特定争论而制定的香港习惯法、英国法规及本地条例。仅管英国的物业转易及财产法律有过重大改革(1925年的土地财产法令),然而,直至物业转易及财产条例(第219章)于一九八四年制定,此项改革仍未引入香港:而该条例质为香港首套为规管香港的物业转易及财产法律的全面性法例。
