近几年来,我国城市化进程加快,城市规模不断过大,处于城乡结合部的农村土地也越来越多地被国家所征用。于是,关于征地款如何分配的问题便成为近郊农村一个极具普遍性的问题,影响了农村的社会稳定和经济发展。笔者通过对27起农村征地款纠纷案件进行了调查分析,试图找出这一问题的办法。一、对农村征地款纠纷案件的相关数据统计(一)2009年共受理6件,审结6件,结案率100%,其中调解2件,判决4件,涉案原告71户396人。(二)2010年共受理9件,审结8件,结案率88.89%,其中调解1件,判决8件,涉案原告94户493人。
In recent years, the process of urbanization in our country has been speeded up and the size of the cities has been constantly over-large. Rural land in the urban-rural areas has also been increasingly requisitioned by the state. As a result, the issue of how to allocate land acquisition funds has become a very universal issue in rural areas of the suburbs, affecting rural social stability and economic development. Through the investigation and analysis of 27 cases of disputes over land acquisition in rural areas, the author tries to find out the solution to this problem. I. Statistics on Dispute Cases of Land Acquisition in Rural Areas (I) In 2009, a total of 6 cases were accepted and 6 cases were closed, with a settlement rate of 100%. Among them, 2 cases were mediation, 4 cases were verdict, and 71 cases involved 391 plaintiffs involved. (II) In 2010, a total of 9 cases were accepted and 8 cases were closed with a closing rate of 88.89%, of which 1 case was conciliation, 8 cases were verdict, 94 cases involving 493 plaintiffs involved.
