案情简介2009年1月,职工王某与某化工企业签订了3年期劳动合同,经过6个月的试用后,王某成为一名正式员工。2012年1月,合同期满,经与企业行政协商,双方愿意再续订3年期劳动合同,但企业要求重新试用6个月。由于工作岗位、工资待遇都没有变化,王某当时也就没有提出反对意见。2012年7月,该公司以王某在试用期内表现不符合录用条件为由,解除与她的劳动合同。
Case Brief January 2009, Wang and a chemical workers signed a three-year labor contract, after six months of trial, Wang became an official employee. January 2012, the contract expired, after consultation with the business administration, both parties are willing to renew the three-year labor contract, but the company requested a re-trial of 6 months. Because jobs, wages have not changed, Wang did not raise objections at the time. In July 2012, the company lifted the labor contract with her on the grounds that Wang’s performance during the trial period did not meet the conditions of employment.
