为了适应我国市场经济的发展,国家决定“土地入市”改革,建立城乡统一的建设用地市场。但是由于现行法律的限制,特别是上位法《土地管理法》为核心的土地管理法律体系,严格限制了农地的流转和农地入市的进程。本文从农地权属、保护农民权益出发,对农地入市改革现状进行了分析,并提出了政策建议。
In order to adapt to the development of the market economy in our country, the state decided to reform “land into the market” and establish a unified market for construction land both in urban and rural areas. However, due to the restriction of the current law, especially the legal system of land management, which is the core of the Land Administration Law of the upper-level law, restricts the circulation of farmland and the process of entering agricultural land. Based on the ownership of agricultural land and the protection of peasants’ rights and interests, this paper analyzes the status quo of agricultural land reform and puts forward policy recommendations.
