如果说海事赔偿责任限制制度是海商法为保护某些海事债务人而建立的一项特别的法律制度的话,那么,船舶优先权制度则是为了保护特殊的海事债权人而建立的一项特别制度。两者的立法目的似乎是相对立的,这就决定了两者可能会面临发生冲突的情形,进而也就提出了应该如何解决这一有关冲突的问题。本文将试着就两项制度的立法目的等进行比较,以分析它们会不可避免的发生“碰撞”的原因及结果;与此同时,对前述现有法律解决该种冲突的规定予以质疑,并就此提出一些不成熟的建议。
