高校学位授予权法律性质存在着“国家行政权”和“高校自主权”两种不同定位,这是高校学位授予标准在校规与法律之间冲突的根源。基于“国家行政权”法律性质定位,高校学位授予案件司法审查存在的困境是,运用法律解释方法无法得出“高校学位授予权属于国家行政权”的结论。基于“高校自主权”法律性质定位,高校学位授予案件司法审查进路主要包括:司法审查范围方面应选择“全面审查”模式;司法审查标准方面应以正当性标准为主,以合法性标准为辅;司法审查基准方面程序问题以正当程序为主要基准,与学术目的相关的实体问题以比例原则为主要基准。
There are two different orientations of the legal nature of academic degree granting in universities, such as “state administrative power ” and “university autonomy ”. This is the root of the conflict between the university degree awarding standard and school rules. Based on the nature of the legal nature of the “State Administration Power,” the predicament existing in the judicial review of university degree award cases is that it can not be concluded by the method of legal interpretation that “the degree award of university degrees belongs to the state administrative power.” Based on the legal nature of “autonomy of colleges and universities ”, the path of judicial review of university degree awarding cases mainly includes: the mode of “comprehensive examination” should be selected in the scope of judicial review; the standard of judicial review should be mainly of legitimacy standard, Legitimacy standards supplemented; procedural aspects of judicial review standards to due process as the main benchmark, and the academic issues related to the substantive issues of the principle of proportion as the main benchmark.
