根据《食品卫生法》第37条和《食品卫生监督员工作规范》等有关规定,食品卫生监督机构(下称食监机构)对违反《食品卫生法》情节较重者实施行政处罚必须制作行政处罚决定书(下称决定书)。由此可见,决定书是食监机构对违反《食品卫生法》情节较重的食品生产经营者实施行政处罚而制作的法律文书。本文拟从法律角度对决定书的特点和制作作一粗浅探讨。
