我国《节约能源法》颁行至今一路步履维艰,实施效果强差人意,其原因在于节能法制度设计存在动因上依赖行政驱动、手段上强化行政管制等制度理念的认识局限。节能必须凸显效率,低效率乃至无效率的节能有悖节能法律制度的根本价值目标。基于我国节能减排的严峻现实,立足对既有节能法律制度的重新审视并更弦改辙,依照效率优先、技术支持、产权保护、利益驱动的理念重构节约能源法律制度,是实现节能减排效率化、常态化、可持续化的必由之路。
