金钱债权执行中,不动产作为执行标的物,对于实现债权人的生效债权来说非常重要。现阶段,受到执行立法等理论研究滞后性的影响,我国现有不动产执行程序难以满足实际需求,存在一些漏洞。文章从房产执行措施的研究意义入手,分析查封房产的法律效力,最后针对已办理与未办理产权的房产对外转让效率进行探讨,希望能够为司法实践提供更多参考。
In the execution of monetary claims, the real property as the subject matter of enforcement is very important for the creditors’ effective creditor’s rights. At the present stage, due to the lagging influence of the implementation of the theoretical research such as legislation, the existing real estate enforcement procedures in our country can hardly meet the actual needs and there are some loopholes. Beginning with the research significance of real estate enforcement measures, the article analyzes the legal effect of the closure of real estate, and finally discusses the efficiency of external transfer of real estate that has been handled and not handled, and hopes to provide more reference for judicial practice.
