一、商标权保护的正当性基础——公共利益商标是能够将一个企业的商品或者服务同其他企业的商品或者服务区别开来的标志。换言之,商标是一种用于商品或者服务上的特定标记,消费者通过这种标记,识别或者确认该商品、服务的生产经营者和服务提供者。微观经济学认为,商标至少具备两个方面的功能:1.鼓励生产高品质的商品;2.降低消费者的购物成本~[1]。从历史的角度看,商标作为一种社会现象被纳入到立法者的视野之初,是作为反不正当竞争
