近年来在中国的劳工抗争中出现了对“权利说辞”的频繁使用,这到底意味着公民“权利意识”的崛起也就是国家的撤退,还是反映了民众“规则意识”的延续以及国家的持续控制呢?本文对一组国有企业退休工人在十年抗争过程中使用的各种文本进行了“话语实践”的分析,认为抗争工人所使用的话语依赖于具体的斗争情境与权力关系,而国家的各种制度安排在工人抗争的过程中促进了他们对自己利益诉求的合理性辩护。工人们对“权利说辞”的策略性使用一方面展示了国家对工人们的符号性支配,由此成功遏制了劳工抗争,防止了社会矛盾的激进化危险,但是另一方面它也揭示了只有真正实行“法治”才是制度化地吸纳社会抗争的持久途径。
