[要点]商品房买卖合同纠纷系合同纠纷,因不涉及不动产的权属争议,故不适用《中华人民共和国民事诉讼法》第34条第(1)项规定的不动产专属管辖,而应适用合同纠纷管辖原则,由被告住所地或者合同履行地人民法院管辖。
