正义是一个悠远而永恒的话题,而刑罚的正义可以通过刑罚权的起源和刑罚权的目的加以说明。启蒙时代以来,欧洲在刑罚如何更加人道和尊重人性、维护人权这方面孜孜以求,反映到电影中也能管窥一二。围绕美国电影《一级谋杀》中主人公的犯罪经历,探讨刑罚究竟为何而来,又因何而去,正义之路究竟离我们还有多远。
Justice is a distant and eternal topic, and the justice of penalty can be explained by the origin of penalty right and the purpose of penalty right. Since the Enlightenment, Europe has been diligently pursuing how punishment is more humane and respecting human nature and safeguarding human rights. It is also reflected in the cinema’s insight into one or two. Surrounding the criminal history of the protagonist in the “First Murder” of the U.S. film, we examine why the punishment actually came from and why the path of justice is far behind us.
