本文从当今市场经济发展的宏观条件下详细分析了我国物权法的商事适用性。笔者选取了物权法的交易安全价值、商事交易多样性价值和便捷性商业价值,并且结合我国物权法中的典型制度,对其立法出发点和功能进行深入分析,从而探究出各自的商业法价值。另外,结合了我国新颁布的不动产登记暂行条例,以及目前物权法中尚且阻碍其发挥商事适用性的不足和缺陷,从而对我国物权法修改工作提出有限的建议。
This article analyzes in detail the commercial applicability of the Property Law of our country from the macroeconomic conditions of the current market economy development. The author chooses transaction security value, commercial transaction diversity value and convenience commercial value of Property Law, and analyzes the starting point and function of its legislation in light of the typical system in China’s Property Law to explore its own commercial law value. In addition, combined with the newly promulgated Provisional Regulations on Real Estate Registration, as well as the current Property Law also hinder its commercial use of the deficiencies and shortcomings, so that the reform of China’s property law made a limited proposal.
