关于有没有非洲法系的争论 ,已经有一个多世纪了。说有的少 ,说无的多。本文以大量史实雄辩证明 :非洲法系确确实实存在。在非洲法系中 ,习惯法占多数 ,制定法占少数 ;在制定法中 ,不成文法是多数 ,成文法则较少。非洲各国的法在所有权问题上的大体一致 ,以及关注集体利益甚于个人利益的共同之处 ,更说明一个独立的非洲法系是客观存在的。文章还用丰富史料驳斥了非洲没有商法的论点
There has been more than a century of debate about the existence of African legal systems. Say some less, say no more. This essay uses a large number of historical eloquence to prove that African legal system does exist. In African legal systems, customary law makes up the majority and statutory law makes up the minority; in the statute of law, the unwritten law is the majority and the written law is less. The general agreement of the laws of African countries on the issue of ownership and the commonalities that focus more on collective interests than on personal interests also show that an independent African legal system is an objective reality. The article also uses abundant historical data to refute the argument that Africa has no commercial law
