长期以来检察机关对法院民事行政诉讼活动仅能以抗诉的方式进行监督,但相较宪法法律所赋予检察机关享有的法律监督权及诉讼监督权而言,存在“监督机制与体制不相匹配”的问题,更与目前司法体制及工作机制改革中关于加大检察机关诉讼监督力度的目标和要求不相符合;司法实践中存在的民事行政诉讼活动违法行为迫切需要被监督和纠正,各省级院在对民事行政诉讼活动违法行为进行监督调查进行了卓有成效的探索后建立了制定了系统的监督机制,并被最高法与最高检《关于对民事审判活动与行政诉讼实行法律监督的若干意见(试行)》所肯定。本文就民行诉讼活动违法行为监督调查的机制构建提出一些具体构想。
