随着依法治国、依法行政的不断推进,政府法律顾问制度倍受重视。各地出现的四种政府法律顾问配置模式中,以政府法制机构担任政府法律顾问,并兼顾吸收和管理社会法律人才为政府法律顾问模式最为适宜。但其也存在四大局限,暴露了一些问题。为此,提出了强化政府法制机构法律地位、严格政府法律顾问选拔和管理好、使用好两类法律顾问人才等完善政府法律顾问制度的对策。
With the rule of law and the continuous promotion of administration by law, the system of government legal consultants has received much attention. Among the four types of government legal advisers and disbursement models that appear throughout the country, it is most appropriate to take the government legal institution as the government legal adviser and also to absorb and manage the social legal talents as the government legal adviser model. However, there are also four major limitations that expose some issues. Therefore, some countermeasures are proposed, such as strengthening the legal status of the government legal institution, strictly selecting and managing the government legal consultants, consummating the two types of legal consultants, improving the system of government legal consultants.
