公共服务外包中,政府对非营利组织问责是一个“委托人如何监督和规范代理人行为”的问题,还是一个在效率价值和公共价值之间作出权衡的问题。问责是为了规范代理行为,以及维持私人理性与公共价值之间的动态均衡。政府管制、合同规制与管理、非正式协议之间相互补充而构成政府问责的依据和工具箱。无论是直接管制,还是合同规制,抑或非正式协议,政府既要保证非营利组织规范运作,又要确保其优势的发挥,政府问责有其自身的限度,为弥补政府问责之限度,必须构建“多元问责”。
In public service outsourcing, the government’s accountability to nonprofit organizations is a question of how the client should supervise and regulate agent behavior, or a trade-off between efficiency value and public value. Accountability is to regulate agent behavior and to maintain a dynamic balance between private rationality and public value. Government regulation, contract regulation and management, and informal agreements complement each other to form the basis and toolbox for government accountability. Whether direct control, contract regulation or informal agreement, the government not only guarantees non-profit organizations to standardize their operations but also ensures their advantages.
