裁定魁北克法裔文化群体的“自决权”应该在现存的宪法框架内,追求政治、经济和文化以及社会发展的“内部自决权”。与法治原则相比较,后者更为优先。加拿大最高法院针对少数人自决权的宪法解释,还显示出在政治问题转化为法律问题的过程中,文本主义的原旨主义宪法解释法具有独到的作用。而多种解释方法的交替适用,贯通概念法学和自由法学的做法则有利于解决宪法领域中诸多带有强烈政治色彩的法律问题。
It ruled that the “right of self-determination” of the French-speaking Québec cultural group should pursue “internal self-determination” of political, economic, cultural and social development within the existing constitutional framework. The latter is a higher priority than the rule of law. The Supreme Court of Canada’s constitutional interpretation of the right of self-determination of minorities also shows that the original principle of constitutional interpretation of textism plays a unique role in the process of translating political issues into legal issues. The alternative application of multiple interpretations and the practice of conceptual jurisprudence and liberal jurisprudence are conducive to resolving many legal issues with a strong political flavor in the field of constitutional law.
